Legal Question in Family Law in California

Can she press charges?

My son is 16 and he has is gf that is 16 too. We live in California and recently they both told me and my husband as well as my sons gf's parents that they've had sex before. The situation is that my sons gf's parent are threatening to press charges against me and my husband. Are there any charges that she can hold us against?

Re: Can she press charges?

First an individual cannot press charges against anyone. Only the district attorney can press charges. Sex between minor is quite common and is seldom results in any criminal proceedings, unless force, or drugs are involved. As a parent it is unlikely that you would have any criminal exposure. If these threats continue consider retaining counsel for yourself and separate counsel for your son.
