what to do first? not previously married want partial custody

My baby's mother is talking about leaving the state? I currently have my 3yr old daughter 35% of the time and I give her a check each month(not through the courts) I want to file the paperwork to keep things the way they are, she lives in a different county??

You need to file a paternity action and custody/timesharing motion in the county where the child resides. Good Luck, Pat McCrary
