how to proceed when separated from husband

I am married in mar 2007 in India and joined my husband in may 2007 in CA after completing my exams. stayed for 4 months with him and came back to my home country as situations were not good. As I am in India for these months, can you please suggest how and in what way should I proceed to get divorce or to get my rights.

You would probably be better to file in India for divorce or annulment as California does not have jurisdiction until you have been here for 6 months. That way you can avoid all of the travel connected with a California lawsuit.
