Legal Question in Family Law in California
I am in the process of trying to get a dissolution of marriage, we'll have been married for 5 years in November. I was told the process was as simple as just filing the proper paperwork but it isn't as simple if there is property involved. I own my own home, but his name isn't on the house at all. Do I have to go through the whole court process with the filing of papers and serving him and all of that or can I still fill out the paperwork and file it with the courts myself?

I don't know who you talked to but they did not know what they were talking about. If you want to dissolve your marriage you have to file papers with the court and have the other spouse served. It is irrelevant whose name is on title to the home as paperwork must still be served.
