Proof In Court

I am currently in a custody battle with my ex-boyfriend. We were never married. Recently he gave up his 1 month temporary custody of our son becasue he said he was being activated in the military. He showed no proof in court, in between those times he has still visited with my son and has been seen sround town at clubs as if he were never shipped off. Does he need to show some kind of proof that he really was in the military and really called to duty?
