Proof Needed to show fondling of child by parent

1 Would like to know what constitutes fondling of 2 year old minor child by parent in a custody/divorce

ex parte proceeding, and

2 what actions to take in bringing up possibility

3 what proof is required

Abuse charges are easily made and hard to prove. CPS should be notified so experts can interview the child.
