Proof of Service
I filed for divorce in 2/2006 a friend served my ex papers by mail since he was in a program. After the ex appeared for mediation and the custody/ visitation court date, I received a notice that the proof of service was rejected due to 2 boxes being checked when only one 1 was allowed. There was a court date set for ''order to show cause'' due to nonproof of service &case was left open due to previous orders made by the court. So what do I do now? Do i simply re submit the proof of service? I know he wont sign a notice of acknowledgment especially now that I found out he is now incarcerated. Any help will be greatly appreciated.

Submit a new proof of service based upon the previous service with the correct boxes being checked. You may talk to the facilitators office of your court or an attorney to assist you in filling it out correctly. Good Luck, Pat McCrary
