No prop. stettlement with in 5 years! Help

I seperated from ex in 85 filed in for uncontested divorce 87.I called clerk of court for decree in 2001, was told final decree was never issued because of no propertty settlement filed with in the 5 year required period. Is there a way to amend/refile/plead/ request the original filing be validated and back dated by the court to 1987?

there was a child support order i have been paying all these years. I need paperwork for a deployment plan ASAP.

If there has been a child support order then the matter was probably not dismissed and you can take a judgment in the original case. Get copies of your file for review. Once you have the file, you may fax a copy of the file to me and I can tell you what needs to be done. You will probably not need to appear in court. You can get a copy of the file by writing to the clerk of the court, business office, with a self addressed stamped envelope. Enclose a blank check made out to the court with the notation "not to exceed $25" to cover the costs of copying the file. Good Luck, Pat McCrary
