Legal Question in Family Law in California
Was I properly served with legal papers?
I have not proceeded with the completion of my divorce after my lawyer insisted that I do it in pro per. This was because my bill is too high and my husband, who does not have legal representation, will not cooperate or come to an agreement. I was told by my former attorney's legal assistant that the temporary orders for support, custody, & visitation, would stand until changed by one of the two of us by going back to court and continuing with the divorce. My husband (who has a restraining order against him) had a woman come to my office, asked for me and handed me the following: FORM INTERROGATORIES pages 1 & 2 (with every item checked off), SCHEDULE OF ASSETS AND DEBTS, and a note stating, "You have 30 days to respond. If you don't, on day 31 I go to court." My question is, was I legally served? Do I need to fill out this form and send it to HIM? It looks like he just printed it out and hand wrote the info on the top portion of the FORM INTEROGATORIES' first page.
