PRO/Perm Restraining Order
A permanent restraining order was given to my daughter's father for me to stay away from him and my daughter. What paperwork can I file to get the PRO set aside so that I may seek custody of my daughter? The PRO was given based on perjury by my daughter's father. Second, the day the PRO was granted, I was at the court but not present in the courtroom because I had my newborn child with me and children are not allowed in the courtroom. The Bailiff did not come out of the courtroom to call me when the case was being heard. I am seeking custody of my daughter for I am her primary parent and once again, her father manipulated the court to seek custody of her. The PRO is for me to stay away from her as well as him.

You need to bring a motion to set aside the order and to establish a custody/visitation order. Good Luck, Pat McCrary
