Legal Question in Family Law in California

Property

My husband is the legal owner of our condominium. If I leave him and he changes the locks, what legal rights do I have to get into our property to make sure I retrieve furniture and other documents and clothing that belong to me? What should I do if my husband locks me out of our home?

Re: Property

What do you mean by legal owner. If you helped pay some of the condo during marriage, or if you husband used his wages to pay for the condo during marriage, the condo would be partly community property no matter what the deed says. As far as your legal rights if you were to move, you could take your personal effects and belongings with you when you move. If however you leave community property in the residence after you move, you would most likely need a Court order to get possession of community property until the Court splits the property.
