Legal Question in Family Law in California
Property Prior To Marriage-Do I have to split
I am 39 my husband is 65. Married almost 9 years. I owned my own business prior to marriage. Husband never worked except for me during marriage. Not on the books though due to tax liability on his side. Have Seperate Property Agreement stating business is mine solely. Do I have to split my business with him. Want to be fair but don't want to give up my stability. He has nothing without me. Nothing coming in and nothing going out technically. I am not sure how I am protected. Is my business in jeopardy? Do I have to pay allimony due to his laziness and lying? Thank You!

Re: Property Prior To Marriage-Do I have to split
From what you have given me, the business is your separate property. Discuss this with a family law attorney who can ask for more detail and give you a more definative answer. You probably owe some spousal support. Would like to give you a better answer, but each case is decided on its facts and there are many variables in your situation. Good Luck, Pat McCrary

Despite agreement that business is your separate property, monies earned during marriage and equity added during marriage are considered community property, unless otherwise agreed. Many factors to be considered. Call. Don Holben 800-685-6950

It is not possible to answer your questions without first reviewing the Separate Property Agreement that you mentioned.
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
