Legal Question in Family Law in California
Protecting My 2 Month Old From His Ex
In a relationship with male who previously was married. His ex recently stated that WE tried to kidnapp his 12 yr daughter even though it was his weekend and she approved us keeping daughter longer due to holiday. She sent police to our home.
How can I protect myself and my 2month old baby from her lies and manipulative behaviors? Due to the fact that she was trying to say that not only father but myself included would be brought up on kidnapping charges. I don't want my child taken away because of her irratic behaviors. She never follows the court order - keeps the daughter from the father constantly even though father pays all child support on time and provides health insurance, and other such needs for the child.
Again how can I protect myself and my child from her stories that could potentially take away my child from me?

Go to court and get a court order giving your husband specific dates and time for visitation. The best option for this appears to have visitation on the first and third weekend or the second and fourth weekend, along with 1/2 of the fifth weekend. Most often the weekend is defined by the place Saturday has on the calendar. Include holidays vacations and about 1/2 of the summer vacation. Then keep a certified copy of the cour order with you at all time. This will provide notice to the police that you have custodial right to the child.
