Legal Question in Family Law in California

proving a contemt

I have all proof I need to prove a contempt against a person except how to prove the person works and where. Do I need to file an oreder of examination and/or a writ of execution befor the individuals trial date so that they must provide their work place ? if so, can I ask for an extention on the trial date if the courts sets dates for the examination or writ which would be after the contempt trial date. Also, if the persons new wife is a witness, do I have to sopeana her in order to ask her questions at this trial ? Thank you,--name removed--Wells

Re: proving a contemt

File an OSC or Motion for contempt, make the request fro information via interrogatories, and you do have to subpoena her. Request a continuance prior to the the TSC or TRC. You may be too late on the discovery if it's within 30 days of trial, unless a stipulation to keep discovery open longer has been made.
