Legal Question in Family Law in California
Proving husband is an alcoholic
My husband is a high functioning alcoholic. He goes to work and provides financially. While he is home, he drinks until he goes to bed, on the weekends, it is the same. We have 2 children, and if I leave the house, he is drunk with the children and looks at porn on the computer. It is not child porn, and he ''hides'' it from the children. My question is, do I have to wait until they see something to prove that he is unfit? On paper he looks great. My Mother in Law has offered to pay for a lawyer, and my sister has offered a place to live. Problem is they live out of state and he would want to have visitation. Is it illegal for him to be wasted at home with the children? What do I do? Can I videotape his behavior? Any advice would be appreciated.

You need to see an attorney to plan a for the dissolution. Based upon the situation, you should do that today. You should not leave the children alone with him. CPS could charge you with failure to protect. Good Luck, Pat McCrary
