Legal Question in Family Law in California
Pternity testing..my rights?
Last year I broke up with my boyfriend and then had a ''fling'' with a guy who was a friend of a friend. When I found out I was pregnant, I originally thought it was his, until I went to the Dr.'s and they told me I was further along than I thought and that I was pregnant while I was on my last period, which would mean it was my ex's. I had my daughter on March 10 of this year and now this ''fling'' heard through a mutual friend that I had her. Now he is demanding a paternity test, although he was at the dr's with me so he heard the dr say this also. He is one who likes drama and attaches himself on any possible situation to have attention focused on him. Anyways, a genetic lab called me and wants to send someone to my house to swab me and my baby. This makes me very uncomfortable and is very unnecessary. I want to know if I have any rights as to denying the test. I haven't even seen him since last summer and I don't want to do this. Do I have any rights at all? Is it worth making him take me to court over it?

Re: Pternity testing..my rights?
He could file a paternity action and require genetic testing. The swab is a very unintrusive method of testing. It would probably be easier on you just to have that completed and then if the fling is not the father you will be have that behind you. Its cheaper than going to court and hiring an attorney.
