Legal Question in Family Law in California
Punishment for keeping child out of state and unpaid childsupport
I am wondering what the past court response has been to a
parent that keeps a child against custody orders out of
state and has years of unpaid child support. I am wondering
what the reponse has been historically twords men and twords women if the reponse has been different.
Thank You

Re: Punishment for keeping child out of state and unpaid childsupport
Historically, the parent who is not paying child support goes to jail for contempt of court. There are a few ways, however to get out of going to jail--hide out for ten years and hope the other parent or DA does not file a request to renew judgment, file bankruptcy and make a repayment plan, or become the citizen of another country that does not give comity to US child support orders. Making the argument that the mother concealed the child, although theoritically recognized as case law, is a pretty good way to give the court the opportunity to put you in jail. Don't forget to bring your toothbrush.
