Legal Question in Family Law in California
purgery
My ex constantly lies in legal statements submitted to the court. Most recent stated that he was not interviewed by CPS and that I filed a false report. I am tired of him getting away with lying through his attorney and signed documents. Can I file some sort of document and will the court proceed with punishment?

The fact is, there are soooooo many people that lie to the court. I would love to see this disrespect addressed, but it never has to my satisfaction. All you can do through your own attorney is show the court proof these statements are false. Even if no fine is imposed or it seems like they are getting away with it, believe me, those judges do notice and it does affect the decisions they make. If you don't have an attorney, I would advise you to do whatever you have to do to get one, because child custody is too emotional for anyone to handle well themselves. I have seen too many people walk into my office after they have represented themselves and decided they were unhappy with the outcome. It ends up costing them more in the long run, financially and emotionally.

You must address the lies at the time they are made. Take the time to deal with one at a time. Be prepared. Don't simply tell the Judge that he is lying. Support your position with collateral evidence.
