Pursuing Back Child Support

I have an active court order for child support via Child Support Services in California. Father lives in NC. Father does not work. Father cares for his 2 small children while his wife works and supports the household. Support services in CA say they cannot file a �Job Seek Order� because they have no jurisdiction in NC. Currently father owes $3000 in back support, includes childcare cost for our young child that needs all-day care. Are there any legal options where I�m able to legally pursue the back support amount ($3000) outside of Child Support Services in CA? Can i pursue back support amount via small claims court?

DCSS will pursue whatever the existing order is for you, albeit, with varying degrees of success.

If you want to do more than that, you may need to file a court action in NC, or have a CA lawyer handle some enforcement of your current order. You don't need a CA small claims judgment, that accomplishes nothing. You have a court order, your problem is getting it enforced, not getting another one.

Since father lives in NC and you live in CA, you could contact the US attorney and request assistance in enforcing the child support order. It is a federal crime to not pay child support, if the parents do not live in the same state.
