Legal Question in Family Law in California

What is a "QDRO"?

I was awarded 1/2 of my ex-wife's retirement under the stipulation of a "QDRO".

in our divorce decree.

I plan to retire from my job next year. I would like to receive the above referenced income as a supplement to my retirement.

How do I go about setting things into motion in order to receive my portion of this retirement?

Thx

Re: What is a

The place to start is by reading the "QDRO" or Qualified Domestic

Relations Order. It states what your rights are in your ex-wife's retirement.

You may have to contact the Plan (which will be named in the QDRO) to make

sure they have been served with the QDRO, and to have them describe

what arrangements they can make with you.

It may be that you cannot take any of the funds until your ex-wife is eligible to

retire. It may be that you can "cash out" your benefits. You should make sure you

have received advice about the long term effects, and tax consequences, of any

option you select.
