Legal Question in Family Law in California

Need for QDRO?

My husband and I were married for 14yrs. We divorced, he did not remarry, and he passed away 5yrs. ago. I have since become disabled and would like to receive his pension that I am eligible for. I have been told by his previous employer that I would need to get a QDRO. Why is this? I thought a QDRO wasn't a QDRO unless you had someone to serve it to? Please let me know if or why this is necessary. Thank you.

Re: Need for QDRO?

His employer needs an order to pay a portion of his retirment to you. Contact an attorney the prepares QDRO's. Also get a copy of the court order giving you a portion of the retirement. This attorney should help you.
