Legal Question in Family Law in California

Do I quailfy for any type of public assistance

We became legal guardians of my

common law spouses grand daughter

back in Nov 06 due to both parents

unable to care for there daughter.

We applied for public assistance and

was denied due to fathers name not

being on the birth certificate

therefore could not prove

relationship. We tried to get child

support and was deined due to name

not on birth certificate. I am the sole

support of my home and I am legally

not related to the subject other then

legal guardian and would

like some type of support. On the

court documents it states that she is

entitled to ALL welfare,social security

ect.... What are my options

If you have letters of guardianship you should qualify for AFDC. The fact that father's name is not on the birth certificate should not be a problem.
