Legal Question in Family Law in California

qualified domestic relations order

My ex-husband has been a teamster for 30 years. We were married for 27 years. I believe I'm entitled to a portion of his pension. The teamsers office said I need a Qualified Domestic Relations Order to apply for pension benefits. How do I do this? I live in Illinois now, but lived in Southern California during the marriage.

Re: qualified domestic relations order

Where were you divorced? Did you obtain a judgment for yor share of your ex-husband's retirement benefits in the divorce? If so, your attorney would have drafted a QDRO, obtained the plan administrator's approval, obtained the Judge's signature and provided the final QDRO to the plan administrator. Your job would be to keep the plan administrator advised of your current mailing address so that they can send you your share of the benefits.

If your attorney for the divorce did not prepare one, or if you represented yourself, you should hire an attorney to prepare a QDRO, get it entered, and get your share of his pension transfered to you asap.
