Legal Question in Family Law in California
How can I qualify for divorced spousal benefits?
Almost aged 62 now, do I qualify for divorced spousal benefits? I was married 18 years -or so I thought. Unknowingly, we married after the interlocutory of my first brief marriage but before the final judgement of that divorce, and found out 10 years later. We remarried at that time and divorced 8 years later. so does that leave only 8 years of marriage?
Am I 2 years shy of spousal benefits? I have never remarried.

While length of marriage is taken into consideration when spousal support is requested, it is not a final determining factor. I believe the court will take into consideration the first ten years when you both believed you were married. In California there are also laws re palimony that might come into play. You need to contact attorney to look at the entire matter for counsel.
