Legal Question in Family Law in California

I qualify to get a home loan with my credit and income, however i am married and he has bad credit, so its stoping me from getting the loan. I was told if i was legally separated, i could get the loan. Is this common? What does legal separation involve? Court or just a notarized agreement? If the legal separation was done, would there be any legal ramifications if we were not really separated?
