Legal Question in Family Law in California
quash to motion
I filed for divorce on 6/23/00, spouse was served on 7/7/00, and on 8/18/00, I was told by the paralegal site i hired that my spouse's attorney had filed a quash motion.
Now I have to pay extra for a real attorney.
Spouse has sold our business to our older son for $ 1.00 without my approval.
I am being billed by collection agencies for bills from the above business. I know he is running our ex-business, but he has no business license nor State of Ca resale certificate. I notified landlady, IRS and State Board of Equalization that I no longer had interest in the business.
I am allowing my employer to deduct a monthly Kaiser Health Plan premium from my monthly paycheck, and spouse has not been removed as a dependent. He is being covered by my employer Vision and Dental plan as well.
Will I be screwed financially?I
What should I expect?

Re: quash to motion
It sounds like your spouse may be attempting to fraudulently transfer your community property assets. If what appears to be so is in fact what's happening, you definitely need to see a lawyer. As for the health insurance, you may have continuing liability for your spouse's health-related bills unless you can prove you're separated...so some of that depends on the petition which was filed. If you can't afford a lawyer, the local bar association may be able to offer free or low-cost alternatives. In LA, the Bar association phone number is (213) 627-2727. The Family Law Information Center may also be more help (213) 974-5004.
