Legal Question in Family Law in California

i have a question. My ex is not my daughter real father. If I wanted to change her last name and take him off the birth certificate is that possible. I want to move on with our life and he won't leave us alone. And he has his own other little new family. My daughter is not his blood.

That depends upon many factors. The whether there is a judgment stating that he is the father, age of your daughter and whether he would agree to a determination that he is not the father are three of those factors. If he has a new family it sounds like a lot of time has passed and therefore that would be more difficult to have a determination that he is not her legal father.
