Question regarding the new 2002 law pertaining to CA prenuptial agreements.

I read that there is a new 2002 law in CA regarding prenuptial agreements that reads as follows: ''...It will bar a court from upholding a premarital agreement unless the affected party was represented by an attorney or had waived that representation in writing.''

Do the parties need to be represented by an attorney at the time the prenuptial agreement is signed, or does the representation only pertain to court appearances at the time of dispute?
