Legal Question in Family Law in California
Question about marriage, death, disability and insurance
I love with a man who is terminally ill. He wants to
go to Hawaii and get married very soon. I wuould like
to know the legal implications. First, we want to keep
it a secret that we are married for very personal
reasons. Could anyone find out or would they have to
do extensive research? (For example, if we got married
in HI would it be on public records in CA because we
both live in CA?) Would I still get his insurance
checks or would the insurance company not give me his
checks because I married him knowing that he was going
to die? Would I take on all of his debts and any other
legal responsibilities even though none of those
things are in my name? What might be other negitive
things that I need to know ? He has an executor
for his will. I do not want to interfere nor get
involved in that aspect. Would I become involved by
being his legal wife even though I am not mentioned in
the will as his wife? (I am mentioned as a friend,
however, who will receive some of his things.) He has
very little money and assets. I don't want to get in
the way of his final wishes. How would marrying him
affect my taxes? Would I have to note that in my
taxes? He will only live for about

Re: Question about marriage, death, disability and insurance
Go ahead and get married. there will be no record in CA but the marriage will be legal. You will not have to pay his debts. I dont see any tax problems but check with your CPA.
