Legal Question in Family Law in California
My question relates to a mistake my family law attorney made
Basically, I was in a family law child support hearing and I sued for attorney's fees. Just before the hearing my attorney asked if I knew the amount of my bill and I answered him, no. A commissioner awarded me 50% of atty's fees and when he asked my atty for an amount he estimated $5000. A week later I looked at my statement and it was for approx. $7000. For the past 6 months we have disputed this bill because he said the commissioner would have never granted me an award based on the real amount. I disagree. How would he know. What do you suggest should be done about this. It has upset me for 6 months. Thank you.

your attorney is not being honest with you. it is a simple matter for him to go back to court, without charge to you, and correct the order. he is just lazy.

You can ask your attorney to go back to court to request a change of your fees award based upon a mistaken belief of the amount of his charges. If your attorney refuses to do so, you may want to consider doing it yourself. Be sure you have copies of all of your billing statements.
