Legal Question in Family Law in California

Question Validity of Marrige

I was married in California in 1991, my spouse had applied for a Confidential marriage licence rather than public. I had not seen the document I signed on the date of marriage until today, at which time after searching what WAS a confidential marriage and reading the document, I found it to be incorrect. It does state on the license which I did sign that we were living together as husband and wife beforehand and it is also listed that we resided at my parents address. Neither statement is true. I realize, this means I did albeit unknowningly make a perjurous statement, not reading what I signed, these statements are false according to Pt4 Section 500 Califonia law. I need to know how this affects my marital status as we have been separated almost 4 years and in process of a divorce. Do I proceed with divorce, look into annullment or is this marriage invalid completely? I'm not sure what steps I should take with this new information.

Thank You

Re: Question Validity of Marrige

A California attorney knowledgeable in this area (domestic relations)should opine upon this matter, but I would surmise that the falsities which you allege are contained in what was presumably some type of application for a California marriage license would not be sufficient to have the marriage declared void ab initio(from the beginning) or with sufficient grounds for an annulment. If so, then divorce would appear to be your appropriate remedy for the dissolution of this marriage.
