Questions regarding step-parent Adoption

My husband is going through the process of adopting my 6 yr daughter. Her biological father has had no contact for 5 years (no calls, money, visit, letters, etc). We sent the consent form he ignored it, we did the investigation & got court date. Biological is in jail (in & out all the time) Went to court and he didn't show, yet called request to be present, so we were told to come back as a PD was going to be awarded to him. Now we have a court date in Sept. Is there anyway we will not win this, even though he has never had contact and is always in & out of jail (drugs, robbery, etc.)

There is always a possibility. Bio-dad has objected, and his best defense would probably be to state that you hid the child from him. You should be prepared to present evidence that he could obtain his address if he had made an effort. Such as a member of your family that he knew and could have contacted to obtain information as to your current address.
