Reply: Quick claim deed

In the first instance, using a quitclaim deed will not remove him from the loan, it simply removes him from title to the property. It takes a refinance to remove him from the loan. Secondly, in transactions between spouses, you should consider using an Inter-Spousal Transfer Deed instead of a Quitclaim Deed in California. Finally, if you are not transferring property pursuant to a court order, you should consult with an experienced family law lawyer in having the transfer deed prepared, to make certain that you comply with the transmutation statutes. This can be a very tricky area and you must be very careful!

Good luck to you.
