Quitclaims

I am giving my husband a cash settlement in exchange for him to relinquish all claims to jointly owned real property. I understand a quitclaim will do that. What are the steps to make a quitclaim official other than in the property settlement agreement filed with divorce. Does it have to be filed as a separate document--with whom? Do the properties need to be retitled officially, such as through an escrow company. When the quitclaims are completed, I want to redirect the property to a trust. Can this be done in the same process?

Completing this transaction through an escrow company will cost a few hundred dollars, but it may be worth the cost. It will insure that you receive the quit claim deed when you pay your husband. Neither of you will have to worry about getting the other party to perform their part of the transaction.

Title insurance will insure that there are no unpleasant surprises that result from an unknown lein on the property.
