Legal Question in Family Law in California

raffle winnings

My ex-wife and I have joint custody of our son. She has physical custody. The school he attends raffled a car. Part of tuition which we pay equally, entitles us to 100 raffle tickets. One of those tickets was the winning ticket.

She claims that her half of the tickets won the prize. She states that half of the tickets has her home phone number and the other half have her cell phone number (my half, according to her.). Both set of tickets have our son's name. I never recieved my half of the tickets for different reasons, I didn't pick them up, she wasn't at home the day I want to pick them up, etc. Am I entitled to any part of the car?

Re: raffle winnings

From the facts given, you have a very strong case to have an undivided one half property ownership interest in the vehicle at issue. You paid an undivided equal value for the tuition that produced the winning raffle tickets, and it would be unjust for her to have sole property interest in the vehicle now just because her name happened to randomly appear on the actual winning ticket.
