Legal Question in Family Law in California
I am getting ready to file for a divorce in the mean time my husband recently moved out leaving me and my daughter without money as I am on unemployement. He has been the primary provider since we've been married which has been 12 years. Prior to him moving out we were working with our mortgage company to get a modification on the loan now the has left he say that he not gonna try anymore to get the modification and will not pay anymore of the payments thus allowing the property that we reside in to go into foreclosure. What is my recourse. My name is not on the loan but it is on the property. We agreed and faxed a paper to the mortgage company saying he gave me authority to obtain information and so forth. Any information you can provide will be appreciated.

You need to file right away and file a request for temporary orders for child and spousal support and to maintain the mortgage. You don't have to hire an attorney to represent you, but it's a good idea in a situation this complex.
