Legal Question in Family Law in California
I received the following documents from my ex-wife. State of California: SUB-010 deposition subpoena for production of business records, SUBP-025. I have 3 of these... One is for bank records, one for police records, another for past employment. I can not afford a lawyer. I'm on retired disability from military on fixed income and barely making ends meet for me and my 2 children. I just need to know do I have to comply and allow my records to be released or can I file objection, if so what is process? Thank you very much and any info would be greatly appreciated.
1 Answer from Attorneys
First, even though you may not be able to afford an attorney for complete representation, it would be very, very helpful to meet with an attorney for a consultation about the matter. Second, you do have to comply with the subpoena request however you may ask for clarification for example limiting the request in time or to a specific location. Example: request for bank records for what time period; or a request for police records from what particular law enforcement agency. You may also object to the request. You may want to contact the Family Law Facilitator for assistance in identifying the forms that you would need to file to get the scope of discovery limited. The Facilitator's program is based at the Superior Court where the divorce has been filed.
