Legal Question in Family Law in California
I recently had a custody hearing and lost. my ex had asked for phsy custody of our 6 yr old ,due to her poor attendance in school due to illness the judge ordered phsy custody to my ex .now i had proof of dr. notes and all i thought i needed to prove that i wasnt just being a lazy parent and not taking her to school. i lost. my daughter had accused her soon to be step sister age 13 of sneaking into bed with her at night and molesting my daughter,i had taken the steps to report it but my little girl was to shy to give the2 male officers details about the on going abuse ,i was told there was nothing that could be done .i told the judge and he still ordered her to live in my exs home "lets see how this works" as if it was an experiment .the judge did say that counseling is ordered before my ex takes phsy custody . i need to help her she is so scared of this girl and my daughter cries when she thinks she about having to go to her dads to live .my ex is trying to act as if its all ok but its not ..i will get my daughter on weekends and my ex said maybe once a week .it is all about support for him .please what can i do?

If you lost at a custody hearing that isn't necessary the end of the road. Simply stay vigilant and prove yourself to be a fit parent by following the guidelines imposed by the court. Additionally i would contact your local self help center in the court house to determine whether filing another motion for custody might be appropriate. It may be premature if the last custody hearing was final. If it was temporary you may just be at the beginning of your custody battle. There are many self help books available for self represented individuals.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
