Legal Question in Family Law in California

I recently lost my job. I have a child support obligation that I can no longer afford to pay. My child turns 18 in February 2011, but I'm told that under California law I have to make the payments until my child graduates from high school in June. Can I ask the court to greatly reduce, or eliminate the payments altogether due to my current financial situation?

A change of income should result in a reduction of child support, but you need to file a motion with the court seeking the modification. Child support remains payable for a child who is a full-time high school student until graduation.

You need to file your motion to modify as soon as possible as the court only modifies support retroactive to the date the motion was filed not the date you lost your job. Good Luck.
