Legal Question in Family Law in California

Reconciliation and child custody matters

A year and a half ago I foolishly signed a child custody agreement giving custody of one of our two children to my husband. He said it was for tax reasons and at the time we were still living together. Come to find out later it was also a legal separation. We split up for a short period but recently have reconciled. Both children remained with me during the separation. My question is, what are my legal rights pertaining to my children now that we are living together again? How do you nullify a legal separation or does living together automatically do that? Will that automatically give me my custody rights back? Thank you so very much for your time.

Re: Reconciliation and child custody matters

You should put your concerns to rest regarding child custody as the court always retains jurisdiction on this issue and will consider allof the facts if the matter is ever put into issue. On the other hand, the contents of the separation agreement should be looked at carefully by a lawyer in your area as it may have a devastating effect on you financially.

I reccommend having your paperwork reviewed by an experienced family law attorney. I would be leery of any attorney who gives you an opinion without first reviewing your paperwork.

Good luck to you!
