Legal Question in Family Law in California

Recording a minor child

Is it legal to record conversations with a four year-old adopted daughter? She sometimes talks of activities with her biological father that are concerning but he has told her their time together is ''secret'', and attempts to get her to discuss them with a therapist or a court-appoined advocate have not been successful.

Re: Recording a minor child

California law requires that all parties being recorded must consent. Since your child cannot consent to the recording you as the legal guardian can consent to the recording. Further taping a conversation of a felony does not require the consent of all the parties. Record the conversation and then report this to the police. If she was abused then action should be taken to protect other children.
