Legal Question in Family Law in California

reinstatement of spousal support

I was awarded spousal support until either I remarry or I die. My ex had it modified when I went to prison for 2 years. He told me he did not have to pay me anymore support because of the modification. I believed him. The paperwork states I could have it reinstated once I got out. I would like to know who's responsibility it is to notify the courts that I am no longer under the states custody, mine or my ex's? Isn't it his responsibility? Is this possibly a civil case? Since I told him I wanted the spousal support back he has been in touch with his lawyer and I know he is hiding his assets, which are considerable. We were married for 18 years.

Reply: reinstatement of spousal support

In a general sense, unless your paperwork states otherwise, it is your responsibility to have the support reinstated.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

It is your responsibility to get the spousal support reinstated. I would suggest that you retain an attorney as there are going to be some difficult issues to deal with. Good Luck, Pat McCrary
