I decided to work save money and leave him taking both my girls... after we broke up i tried to keep the relationship friendly in attemp to keep a peacefull relationship it did not last very long untill he became agresive again and had to leave before our last confrontation he had persuaded me to have his mom look after the girls over the weekend. he has now filled for custody claiming i am unfit to be a mother and has contacted CPS claimimg i neglect my kids. I am a working able mother that has not only been the only one working through out the entire relationship. he is a 3 hundred pound man who was homeless, is jobless and with an extensive criminal record that includes a felony roberry. and is currently on probation. but yet i have gotten no where with my attemps to get my girls back.. i have now gotten a restrainig order and have written custody over the girls from a judge. yet police do not recover my girls claiming he has filled paperwork beforehand. and at an earlier date.. i have no i dea what to do next i have proof of everything. and have not been served but i want to recover my girls asap what can i do???

Your case is getting messy. I would contact an attorney in your area to speak with regarding the custody issues. Since there is a restraining order out you should follow the restraining order until it expires or new orders are made. You should also document all of the false reports he has made against you with CPS if they are in fact found out to be untrue.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
