Legal Question in Family Law in California
Relinquishing Custodial Rights
My husband is being asked by his daughter's mother to give up custodial rights and sign a form stating so. We do not currently see the child or have any contact with her. We are very concerned as to why she would request this when he does not see her to begin with. He pays his monthly child support on time, so we are wondering if she might have an ulterior motive. Should he sign the document and would it affect our family, which consists of 2 children of our own.

Re: Relinquishing Custodial Rights
Signing a document relinquishing parental rights does not relieve him of his obligation to pay support. There must be a court order terminating his parental rights. She may be in the process of a step parent adoption. Unless the daughter is being adopted, there is no reason for him to relinquish his parental rights. He should ask her why she wants him to relinquish his parental rights.
