Legal Question in Family Law in California

my right to relocate to another state with my children

I am divorced with 2 children I have sole legal custody and a restraining order against my ex-husband that includes my children. In the divorce he was given supervised visitation if he complied with some court orders regarding classes. He never complied, he is in jail at the moment and my restraining order is good for another 2 3/4 years. I am remarrying a man in the military and relocation is very possible. Can I move with my children without any legal problems, or is there something I must do legally first.

If you have sole legal custody of the children, presumably, you can move, however, you should review the court orders to see if there is a prohibition to the move. If you do not have a final dissolution decree there is an standard restraining order against moving out of the state. Good Luck, Pat McCrary
