Legal Question in Family Law in California

Relocated to Ca. from NV with permission-Now...

My x-husband let me relocate myself and my two children (7 and 3) to California at the end of Dec. 1998. He was hoping to get a transfer to the LAPD, he is now a cop in Las Vegas. I now have a full-time job and full day care provided by their grandmother. The children are now around stable family members, not different babysitters. Being in Ca. is the best thing for my children. He is threating me to relocate due to the fact that I will not take over the bills and file bankruptcy so he can pursue the LAPD.

He stated he has me on tape and that I have to go back if I will not help him. Please advise how I should go about this. We both enrolled the oldest daughter in school. He comes out for visitation and stays with his girlfriend every

weekend and things were just fine. Please tell me if there is anything I can do?

Assuming the divorce was in Nevada, CA does not have jurisdiction over the issues of custody, unless there is an emergency (father will harm children). Nevada is the decree state. CA could be asked to assert non-emergency jurisdiction after the children have lived here for at least 6 months.

In the meantime, you could litigate the relocation issue in Nevada. I believe you would prevail. I wouldn't do anything against your own best interests, since you would likely prevail in either court.
