Legal Question in Family Law in California

Relocating with minor child

I am the custodual parent of a minor child. I have a court order for child support, there has been no contact with non custodial parent during the last year. I can no longer provide financially, what process should I follow to relocate for better financial opportunity? I want to comply with any court orders. I am unable to hire an attorney I have spent over $12,000 over the past ten years and not much further ahead. Any help is greatly appreciated.

Re: Relocating with minor child

Although there may be no order preventing you from moving, the Father can cause you problems. It may be unlikely, however, it is better to be safe than sorry. If you move without his written permission or the court consent, you could be in for a major legal expense if he objects upon the move. Either get the father's written consent or the consent of the court. You can go to your local facilitators office and ask them to help you prepare a motion. Based on the facts that you have given, a judge should grant you permission to move. You may also wish to talk to the facilitator about assistance in collecting child support. Good Luck, Pat McCrary

unless there is a court order saying you cannot move then you are free to move anywhere you want.
