Legal Question in Family Law in California
Relocation and child custody
My ex husband and I are divorced and live in Los Angeles, CA. I have full physical custody of our 6 year old son and we share legal custody. He does have visitation rights, as ordered by the judge: our son stays with him every other weekend. I would like to move to Sacramento, CA sometime in the next year. I know as soon as I bring it up, he will take me to court.
Our son does go to school just around the corner from his fathers house because his grandmother is able to pick him up while we are both at work. Because he is at their house every day until I can pick him up or they drop him off after work. Will the judge give me a hard time about moving him away from his father and grandparents? I have no problem with giving reasonable visitation, although Sacramento is 400 miles away from LA and not easy or cheap to visit. My reasons for moving are: better school districts, better job, and will be living with my long time boyfriend who currently resides there. Do I have a chance? Or will I just get scolded for wanting to disturb my sons relationship with his father?

Re: Relocation and child custody
That is to be determined by the judge. You can file for an OSC to change custody and see what happens, or you can reach a stipulation with the father on allowing you to move the family to Sac.
Generally though, the parent with full custody can move away if it is reasonable to do so.
As always, please contact a qualified attorney prior to taking any legal action.
Good luck,
