Legal Question in Family Law in California

Relocation and custody of 17 year old

My job relocated from Sacramento to San Francisco (approx 100 miles). I have been commuting on the train (6-7 hrs day) for 9 mths. I have decided to move to SF. My 17 year old son asked to move with me (he will be 18 3/2/08) and his father refused to let him move with me. There is a 60/40 (me 60) custody in place now, however my son seldom spends the night with his father. How likely is it the ex-husband can enforce the custody agreement? Will I have to go to court for a decision?

If he refuses to agree, then you will have to go to court for an order asking permission to relocate. Most likely you will get permission. I was just able to get permission for 2 of my clients to move to another state, and I'm about to leave for court to help another.
