remarriad with imagration connected , discovered prior divorce (16 yrs ago)not f

current marriage of four years, residing 2 years another state AZ. husband is filing permanent status with imagration in CA,and transfered to AZ.

AZ required proof of divorce. found that divorce started 16 years ago had everthing but the final dissolution of marriage was never filed.

have original case showing pettition, and service to spouse. original lawyer has since left his practice unable to contact. x-husband has resided in FL for thoes 16 years and both of us filling taxes as divorced. contacted x-husband last week, asked if he could notorize a statement to that effect, he is in the process of doing that.cildren over 18 years old now and also thought we were divorced.

can the court recognize, by length of time,or by our understanding and representing ourselves as divorced and grant a divorce. with reflection of dates.

and legal document reflecting current marriage was entered into on goodfaith bassed on belief that we were infact divorced.

From you statement it appears that the the petition for dissolution of marriage was filed in California. If that is the case you may be able to get a judgment nunc pro tunc entered, disoloving the marriage effective as of the date the judgment could have originally been entered.

No. your current marriage is not legal. you need to get the divorce and marry again.
